On July 8, 2026, U.S. District Judge William B. Shubb of the Eastern District of California granted a preliminary injunction blocking the Bureau of Land Management from carrying out its September roundup of 856 wild horses across three herd management areas.

The blocked gathers covered 470 horses from the Carter Reservoir HMA, 273 from Buckhorn, and 113 from Coppersmith. All three areas span 196,181 acres along the California-Nevada border.

The plaintiffs were Carter Reservoir Mustangs Inc. and Wild Horse Education, joined by individual advocates. They argued BLM violated the Wild Free-Roaming Horses and Burros Act of 1971 and the Administrative Procedure Act.

Judge Shubb agreed BLM had likely acted arbitrarily. The court found the agency based its overpopulation determination on an assumed annual growth rate, while its own 2025 Environmental Assessment showed actual growth rates in these herds had departed significantly from that number over fifteen years, in many years running negative. The judge dismissed BLM's post-hoc rationalizations about dehydration and range damage.

The ruling addresses the preliminary injunction only. The full case remains pending.

Darice Massey, president of Carter Reservoir Mustangs, said she has documented these horses for decades and knows them by name.

For now, the horses remain on the range.
