CAN AN EMPLOYER WITHHOLD SALARY?

NO.

Under Malaysian employment law, wages must generally be paid on time.

An employer cannot simply withhold an employee's salary because:

✖ Employee resigned without notice

✖ Employee performed poorly

✖ Employee damaged company property

✖ Employee owes money to the company

Unauthorised deductions may expose the employer to legal claims and Labour Department complaints.

THE PROPER APPROACH

1️⃣ Pay the salary due

Comply with statutory obligations.

2️⃣ Calculate any lawful deductions

Subject to contract and applicable law.

3️⃣ Recover losses separately

Through contractual claims, set-off provisions, or legal proceedings where appropriate.

**Can a Landlord Change the Locks?**

❌ **No.**

Even if a tenant owes rent, a landlord generally cannot simply:

* Change the locks
* Cut off utilities
* Remove the tenant's belongings

Doing so may expose the landlord to legal claims for unlawful eviction and damages.

✅ The proper approach is to:

1. Issue a Letter of Demand;
2. Commence legal proceedings where necessary; and
3. Obtain a court order before recovering possession.
